Terms of Service

§1 Scope, customer information

The following general terms and conditions (GTC) regulate the contractual relationship between the company Kenya Chai&Coffee in Gränichen and people (customers) who buy goods via our online shop.

 

§ 2 Offer and conclusion of contract

The offers on the Internet represent a non-binding invitation to you to order goods. They apply while stocks last. After entering your data and clicking the order button, you are submitting a binding offer to conclude a purchase contract. We are entitled to accept your offer within 3 working days by sending an order confirmation by email or by sending the products. If the 3 working days have elapsed without results, your offer will be deemed rejected, ie you are no longer bound by your offer.

 

§ 3 Customer information: Storage of the offer text

The text of the contract with information about the article is saved by us. You have no access to the text of the contract over the Internet.

 

§ 4 Right of return

The company takes back goods in perfect original packaging within 14 days of delivery. A copy of the delivery note or the invoice must be enclosed with the return. A note about the reason for the return is recommended. The costs for the return are at the expense of the customer. In the event of late returns or damaged original packaging, Kenya Chai&Coffee can refuse to take them back.

If the customer has returned the goods properly and on time, the association will reimburse the purchase price minus delivery costs. Damage to the products must be reported by the customer by email within 24 hours of acceptance of the products, stating the invoice number and a description of the damage.

§ 5 Terms of delivery and payment

Deliveries are possible worldwide. Normally the delivery in Switzerland takes place within 2-3 working days after receipt of payment. Individual productions in Kenya require more time. You will receive more detailed information with the confirmation email. Delivery costs within Switzerland are a flat rate of CHF 7.90 up to a weight of 2 kilograms. Parcels weighing more than 2 kg will be charged separately according to the effort. International parcels are charged by weight. Payment is only possible with the means of payment accepted in the online shop. If the products sent by us are not accepted or picked up by the customer and are returned to us, all transport costs will be charged to the customer.

 

§ 6 Retention of title

The purchase remains our property until full payment.

 

§ 7 Claims for compensation

Claims for damages due to color deviations, incorrect images, prices and texts or due to incorrect, late or non-delivery are excluded.

 

§ 8 Warranty

The guarantee is based on the statutory provisions.

 

§ 9. Data protection

The company Kenya Chai & Coffee undertakes to comply with the provisions of the Swiss Data Protection Act and the relevant legal norms when collecting, processing and using personal data. Customer data is only used to process the online purchase, unless the customer expressly wishes to be provided with further information from the association. A transfer of customer data to third parties is excluded, unless this is absolutely necessary for the proper provision of services (order processing). The customer agrees to this use of his data. In addition to the explicitly entered data, information is also automatically collected from the log files. No conclusions about the customer are drawn from this. This information is used exclusively to compile statistics on the use of the online offers in an anonymous form. You can find details on data protection here .

 

§ 10 General provisions, severability clause

Should individual provisions of these terms and conditions be or become fully or partially ineffective, the validity of the remaining provisions remains unaffected. This contract is subject to Swiss law, the place of jurisdiction is Gränichen. The association reserves the right to change the terms and conditions at any time. The currently valid version is published on www.kenyachaiandcoffee.ch and applies from the time of publication.
